Terms of Service

1. Acceptance of Terms

By accessing or using GetWebsiteBuilt (the "Service"), you agree to be bound by these Terms of Service ("Terms") with GetWebsiteBuilt LLC, a California limited liability company ("GetWebsiteBuilt," "we," "us," "our"). If you do not agree, do not use the Service. These Terms apply to all visitors, account holders, and paying customers (collectively, "you").

2. Description of Service

GetWebsiteBuilt builds business websites from the details you provide. The Service lets you create, preview, publish, and host business websites on our subdomain (*.getwebsitebuilt.com) or on a custom domain you control. Your site's content is generated automatically from the business details you enter and template structures we maintain.

3. Accounts

  • You must provide accurate information when registering and keep it current.
  • You are responsible for activity on your account and for safeguarding your credentials. Notify us immediately of any unauthorized use.
  • You must be at least 13 years old to use the Service. Users under 18 must have parental or guardian consent.
  • One account per person. Account sharing or credential reselling is not permitted.

4. Subscriptions, Credits, and Billing

  • Published sites: Each published site is billed at a flat monthly rate (currently $5 per site per month). Your subscription quantity equals the number of sites you have published.
  • Credits: site generation runs on a separate credit-pack model. New accounts receive a small number of free credits on signup; additional credits are sold in one-off packs. Credits are non-refundable and have no cash value.
  • Payments are processed by Stripe. You authorize us to charge your saved payment method for subscription renewals and credit purchases you initiate.
  • Failed renewals: If a renewal charge fails, we retry the charge and email you for 7 days. If payment does not go through within those 7 days, your subscription is canceled and your published sites go offline. You can bring a site back at any time by updating your payment method and publishing again.
  • You may unpublish a site or cancel your subscription at any time from your dashboard. Subscription charges already incurred are non-refundable except where required by law.
  • We may change pricing with at least 30 days' email notice. New pricing applies to the first renewal after the notice period.
  • Taxes (sales, VAT, GST, etc.) may be added to invoices where applicable and are your responsibility.

5. Acceptable Use

Your use of the Service is also governed by our Acceptable Use Policy, which is incorporated by reference. Violations may result in content removal, suspension, or termination.

6. Your Content

You retain ownership of the text, images, and other materials you upload or generate using the Service ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, display, and create technical adaptations of Your Content solely as necessary to operate, improve, and provide the Service to you and your site visitors.

You represent that you have all rights necessary to Your Content and that it does not infringe any third-party rights or applicable law.

7. Generated Content

The Service drafts website copy and related content automatically from your inputs. Generated content may be inaccurate, incomplete, or unsuitable for your specific use. You are solely responsible for reviewing, editing, and approving all generated content before publishing. We make no warranty that generated content is original, accurate, lawful, or fit for any particular purpose, and we do not claim ownership of the content produced for your account.

8. Your Subdomain

  • Publishing on our subdomain gives your site an address like yourbusiness.getwebsitebuilt.com. That address is reserved for your account for as long as your account exists, even while your site is offline for non-payment. Pay again and your site comes back at the same address.
  • If you delete your account or your account is terminated, we may release your subdomain for others to use, but never sooner than 60 days after your site went offline.
  • Subdomains may not be bought, sold, traded, or transferred for payment. Doing so may result in termination of the accounts involved.

9. Custom Domains

You may connect a custom domain you own to a published site. You are responsible for domain registration, renewal fees, and DNS configuration. We publish DNS setup instructions but do not provide domain registration services. Your domain always belongs to you through your registrar; we never take ownership of it. We verify control of a domain through its DNS settings, so if your site goes offline, whoever controls the domain's DNS can connect it to a site on the Service. We may suspend or refuse to serve a custom domain if it is implicated in abuse, infringement, or security incidents.

10. Intellectual Property

The Service, including software, templates, designs, logos, and trademarks created by GetWebsiteBuilt, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. All rights not expressly granted are reserved.

11. Third-Party Services

The Service is built on third-party providers for payment processing (Stripe), hosting and infrastructure, database and authentication, email delivery, analytics, and content generation. Their use of your data is governed by their respective terms and privacy policies. We are not responsible for the acts or omissions of third-party services.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GETWEBSITEBUILT AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.

14. Indemnification

You agree to defend, indemnify, and hold harmless GetWebsiteBuilt and its affiliates, officers, and employees from any claim or demand, including reasonable attorneys' fees, arising out of Your Content, your use of the Service, or your violation of these Terms or applicable law.

15. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account, with or without notice, for violation of these Terms, abuse of the Service, prolonged inactivity, or failure to pay. Upon termination, your published sites may be taken offline, and content from terminated accounts may be deleted after 30 days. Your subdomain is released as described in Section 8.

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Subject to Section 17, any dispute arising from these Terms shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

17. Dispute Resolution; Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO ARBITRATE DISPUTES WITH GETWEBSITEBUILT AND LIMITS THE WAY YOU CAN SEEK RELIEF.

(a) Informal resolution. Before filing a claim, you agree to attempt to resolve the dispute by emailing legal@getwebsitebuilt.com with a description of the claim and the relief sought. The parties will attempt to resolve the dispute informally for 60 days before either party may start formal proceedings.

(b) Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that is not resolved under Section 17(a) will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures (or, for claims over $250,000, its Comprehensive Arbitration Rules and Procedures), available at jamsadr.com. The arbitration will be conducted in Los Angeles County, California, or remotely at the arbitrator's option, by a single arbitrator. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

(c) Class action waiver. You and GetWebsiteBuilt agree that disputes must be brought in an individual capacity only, NOT as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

(d) Small claims carve-out. Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within that court's jurisdiction, in lieu of arbitration.

(e) Injunctive relief carve-out. Either party may seek injunctive or equitable relief in a court of competent jurisdiction located in Los Angeles County, California, to prevent infringement of intellectual property rights or other irreparable harm, without first resorting to arbitration.

(f) 30-day opt-out. You may opt out of the arbitration agreement and class action waiver in this Section 17 by emailing legal@getwebsitebuilt.com within 30 days of the date you first accept these Terms. Your email must include your full name, account email, and a clear statement that you want to opt out. Opting out has no effect on any other provision of these Terms.

(g) Survival. This Section 17 survives termination of these Terms or your account.

18. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least 14 days' notice by email or in-product notification before the update takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
